“The Biggest Cop-Out Ever”: Judge Alan Johnson Refuses to Define “Woman” in Transgender Sorority Case

In the viral lawsuit where sorority sisters from the University of Wyoming fought for the exclusion of a transgender woman from Kappa Kappa Gamma, the legal system has wisely chosen not to cling to outdated notions. As such, conservatives are vastly disappointed.

The Court Will Not Define “Woman”

Judge Alan Johnson made a courageous decision, dismissing the lawsuit and acknowledging that the sorority’s definition of a “woman” is not set in stone. “With its inquiry beginning and ending there, the court will not define a ‘woman’ today,” he said. 

A Wonderful Example

By refraining from equating the gender identity of “woman” to the biological sex of “female,” Judge Johnson set a wonderful example for the nation. Transgender people are supported by modern scientific research. Moreover, the concept of two binary genders is an incredibly Western phenomenon. By refusing to define “woman” in a court, the judge showed respect to the transgender community and different cultures alike.

Avoiding a Narrow Definition

Judge Johnson’s acknowledgment that the interpretation of “woman” was left open-ended by the private organization is a significant milestone. His approach upholds Kappa Kappa Gamma’s right to express their values and avoids imposing the narrow definition pushed by the plaintiffs.

Anti-LGBTQ+ Talking Points

While the sorority’s bylaws might have been written during a time when the need to explicitly define “woman” seemed unnecessary, things have changed and our collective perception of gender has evolved. Artemis, the trans woman in question, encountered hesitancy and was subject to long-standing anti-LGBTQ+ talking points from sisters in Kappa Kappa Gamma. In an interview with Megyn Kelly, the girls who initiated the lawsuit said they felt intimidated, likely due to their limited exposure to transgender experiences. 

The Executive Director Defended Artemis

Kari Kittrell Poole, the executive director of the sorority, defended Artemis’ inclusion by highlighting the organization’s commitment to recognizing gender identity without bias. Society’s understanding of womanhood now extends beyond a simple biological category and the sorority recognizes that.

Acknowledging the Complexity of Gender

Judge Johnson’s stance echoes that of Justice Ketanji Brown Jackson who, during her Supreme Court confirmation hearings, chose not to rigidly define “woman” and acknowledged the intricate nature of the concept.

A “Cop-Out”

While conservative critics have accused Judge Johnson of “putting his head in the sand to duck activist backlash” – with some even calling his decision “the biggest cop-out ever” – the transgender community and its allies see the ruling as a ray of hope in a country seemingly intent on destroying their lives and freedoms.

The Internet Responded

The internet responded to the judge’s ruling and opinions were divided. “It’s easy to define ‘woman.’ A woman has breasts and a vagina. She has periods and she can give birth. Absolute nonsense,” one person wrote. “Hi. I’m a woman and I was born one. I don’t have periods and I can’t give birth. What am I, in your expert opinion? Again, to be clear, I am not transgender,” another hit back. “And what about all the women who have had double mastectomies to prevent cancer? Or older women who can’t have kids anymore? You think you’re defending cis women but actually you’re just excluding a lot of us,” another added.

Hostile and Horrible Sisters

Some commenters called for the transphobic sisters to be kicked out of the organization. “Personally, I think the sorority sisters who filed the court case should be expelled from the sorority for being hostile and just plain [horrible] sisters,” one person wrote.

Following Legal Precedent

Conservative commenters doubted the judge’s decision matched his personal opinions. “Sounds like the judge was just scared of backlash. Coward,” one person wrote. “No, he was following legal precedent. The court had no right to force a private organization to discriminate against trans people,” another hit back.

Creeps Should Be Held Accountable

Some transgender people weren’t sure about the judge’s ruling. One person wrote: “I’m trans and I’m a bit concerned about this. While trans women absolutely should be able to join sororities, creeps shouldn’t be allowed. If what the sisters say is true, Artemis is a creep and that has nothing to do with her gender identity. It could just be transphobia though.”

It Shouldn’t Have Been a Lawsuit

Others were amazed by the entire sequence of events. One individual said: “Absolutely baffling that this got as much attention as it did. It shouldn’t have been a lawsuit. If anything, the girls should’ve made their problems known to the sorority and the college. If the sexual harassment stuff was true, then the college would’ve done something about it. If they refused to, the girls should’ve taken action against the college – not the sorority.”
