The saga surrounding the Trump Organization’s financial dealings is among the more intriguing plot twists in recent US political history. Most recently, an employee of Trump has revealed the latest in Trump’s dodgy dealings, featuring a request to “increase his net worth.” This testimony has greater implications for the civil lawsuit against Trump.

An employee of the Trump Organization revealed in state court on Monday that between 2017 and 2019, Allen Weisselberg, the firm’s top financial officer, claimed Donald Trump expressed a desire for his net worth to be elevated. This testimony may strengthen the New York attorney general’s $250 million civil fraud lawsuit against the former president. 

 

The Role of Patrick Birney

Patrick Birney, a financial operations executive who played a part in evaluating the value of Trump properties and other real estate assets, stated that Weisselberg had mentioned during a meeting that Trump was keen on amplifying his wealth figures in financial statements. These statements, compiled every year, were circulated to lenders and insurance firms for various business benefits. 

 

The Attorney General’s Interactions

Eric R. Haren, an attorney from the attorney general’s office, queried Birney regarding the instructions allegedly passed down to him during Trump’s presidency when Trump’s namesake company was governed by his two adult sons and other executives.

The inquiry from Haren had a specific focus: “Did Allen Weisselberg ever suggest that Mr. Trump wished for his net worth on the [statements] to be increased?”  

 

Affirmation from Birney

Birney responded with a firm “Yes,” indicating that the conversation likely took place in Weisselberg’s office. No further testimony was provided regarding that meeting or Birney’s interpretation of it. 

In the aftermath of the pivotal assertion, Birney exited the witness stand, having provided a major boost to the case. The enigmatic conversation in Weisselberg’s office encapsulated much of the complexity and clandestine nature of the interactions afoot.

 

The Lawsuit and its Accusations

Last year, New York Attorney General Letitia James (D) took legal action against Trump, his adult sons, his company, and two of its longtime employees, including Weisselberg. The lawsuit alleges extensive fraud involving illegal conduct and deception, with James aiming to recover $250 million in purportedly ill-gotten profits, plus impose restrictions that could considerably constrain Trump’s capability to continue operating businesses in the state.  

 

Justice Engoron’s Stance

New York Supreme Court Justice Arthur Engoron has already decided in favor of James on the general presence of fraud. As part of that pretrial judgment, Engoron triggered the initial stage of a receivership process, resulting in the eventual dissolution of Trump Organization entities that were incorporated in the state of New York. These charters were commanded to be revoked. 

 

The Potential Consequence

Legal pundits have speculated that the ruling could lead to Trump losing control of his properties, which includes the Trump Tower on Fifth Avenue – the company’s headquarters, also home to his penthouse residence. 

 

Specific Criminal Acts Allegations

Lawyers from the attorney general’s office insist that particular criminal acts were perpetrated to facilitate the fraud. The civil case, however, cannot result in any criminal convictions or imprisonment for any of the named defendants. 

 

Trump’s Denial

Trump and his legal team deny wrongdoing and argue that the company’s practices were above board. They suggest that disagreements over commercial real estate values are commonplace and that the parties receiving valuations from the Trump Organization did not depend on these statements for decision-making. 

 

The Trial Begins

The proceedings commenced in the New York Supreme Court on October 2, with Trump appearing for three consecutive days.

Between court sessions, the 2024 Republican presidential candidate expressed his disapproval towards the judge and the attorney general. A partial gag order was issued after Trump shared identifying and incorrect details about a court staffer on social media. 

 

A Possible Court Appearance

Trump may appear in court again on Tuesday. His attendance was initially expected to coincide with the testimony of his ex-lawyer, Michael Cohen, but Cohen’s testimony is now anticipated to occur at another time.
