“She’s Obviously Delusional”: Florida Woman Launches $100 Million Lawsuit Against Frontier Airlines

A Florida woman has taken legal action against Frontier Airlines. Amira Hamad’s lawsuit seeks a staggering $100 million in damages.

The Reason for the Lawsuit

Hamad says Frontier Airlines is not the budget airline they claim to be. She’s accused them of failing to consistently offer the lowest fares and says they break down fees into smaller components in order to seem more affordable. She asserts this makes it difficult for passengers to see the true cost of flying with them, which she believes is higher than expected. 

Personal Items Are the Main Issue

One of the biggest issues Hamad has with the airline is the way they handle personal items, which are usually included in the cost of a ticket. Hamad claims that, in May 2023, she fell victim to the airline’s “bait-and-switch” approach when booking a round trip. Hamad claims she was charged $100 for her bag – a bag that she believed qualified as a personal item. 

The Airline’s Website Says Differently

Despite Hamad’s claims, Frontier Airlines’ website lists strict size limitations for personal items. Hamad’s bag did not meet the requirements, as evidenced by photographic evidence included in the lawsuit. Spirit Airlines supposedly had the same size restrictions – but Hamad claims her personal item fit within their size basket. The inconsistency has raised questions about the accuracy of Frontier Airlines’ bag sizer.

Misleading Practices and Breaches of Contract

Hamad claims that Frontier Airlines not only engaged in deceptive or misleading practices – but also breached its contract with passengers and engaged in misleading advertising. Moreover, she claims the airline’s practices violate Florida’s Deceptive and Unfair Trade Practices Act and Consumer Protections Act.

The Lawsuit Could Initiate Change

Hamad is seeking punitive damages of $100 million. Moreover, she’s asking for $10,000 for each alleged violation. She’s also requested a refund of her fees and travel expenses. If Hamad is successful in her venture, the implications for the airline industry could be immense. Perhaps, finally, airlines will have to be upfront about fees.

Social Media Users Discussed the Situation

Hamad’s lawsuit was discussed across social media. “She even admitted that she knew her bag didn’t fit into the sizer before she boarded. Are the attorneys that take on these cases looking for their 15 minutes of fame – or are they just plain stupid?” one individual wrote. “The issue is whether the sizer is the same dimensions as advertised on their website. If that sizer is smaller than what is advertised as being acceptable, that is a ‘bait-and-switch’ and is actionable as an Unfair Business Practice. Somebody has to keep airlines’ feet to the fire.”

Some People Didn’t Understand the Situation

Some online commenters didn’t understand why Hamad was seeking so much money. “She’s obviously delusional seeking $100 million for this ridiculous lawsuit,” one person wrote. “It’s a class action.  She isn’t seeking 100 million for herself,” a second individual clarified. “So who gets the money? Still ridiculous,” the first individual asked. The second person said: “Passengers who have been affected by Frontier’s deceptive practices can claim part but these kinds of lawsuits are mainly to change the offender’s bad practices going forward.”

Others Were Thankful

Some online commenters were thankful for Hamad’s actions. One person wrote: “I’m happy she’s suing. The same thing happened to me on Frontier and I will never fly with that airline again. They stated my bag was overweight and I made sure to weigh the bag before I left home. Somehow it came up 15 lbs overweight, costing an extra $75. What a joke.”

Some Told Personal Stories

Many online commenters jumped at the opportunity to tell their own Frontier horror stories. One person wrote: “I agree with the assertion that [Frontier] truly is not a low-cost airline. I booked two round trip tickets to Vegas and once you add in the luggage, seats, and all the other fees, it’s actually more than the tickets I could have gotten from American [Airlines] with much better flight consistency and seats you can pick.”

Others Doubted Frontier’s Sizer Was Too Small

Some online commenters doubted Frontier’s sizer was too small and, instead, suggested that Spirit Airlines’ allowed more room. “I sincerely doubt Frontier’s bag sizers are too small. I suspect Spirit’s offer a little leeway,” one person wrote. “They are definitely tighter than the actual space under the seat. My bag had a little trouble fitting into the slider but easily fit under the seat,” a second replied.

Some Doubted the Usefulness of Class Action Lawsuits

Over on Reddit, people discussed the nature of class action lawsuits and whether or not they’re beneficial. “Class action lawsuit settlements and subsequent awards rarely financially benefit the plaintiffs. There is the potential for cases like these to affect actual change in business practices, which is good, but the lion’s share of damage awards go to the law firms and attorneys who bring the litigation,” one person wrote. 

But Others Hit Back and Explained Their Purpose

Redditors were quick to explain what class action lawsuits are. Replying to the aforementioned commenter, one person wrote: “That’s the whole point of class actions – to deter giants from bad behavior. It takes a lot of money, expertise, training, and guts to take on Goliath. Those legal gladiators deserve the bounty for stopping bad behavior affecting large classes of consumers.”
