Criminal defendant Donald Trump has told a Colorado court that he had no obligation to “support” the Constitution when he was POTUS.
The Colorado Lawsuit
Trump is attempting to dismiss a lawsuit filed by Citizens for Responsibility and Ethics in Washington (CREW). The suit in question seeks to bar him from the presidential ballot under Section Three of the 14th Amendment.
Trump’s New Claim
Trump’s legal team is now claiming that the clause in question only refers to individuals in offices who have vowed to “support” the Constitution. They say that the presidency does not fall under that category.
A Weak Argument
Trump’s attorneys wrote: “The presidential oath, which the framers of the 14th Amendment surely knew, requires the president to swear to ‘preserve, protect, and defend’ the Constitution – not to ‘support’ the Constitution.”
Preserve, Protect, and Defend
The former president’s legal team continued: “Because the framers chose to define the group of people subject to Section Three by an oath to ‘support’ the Constitution of the United States, and not by an oath to ‘preserve, protect, and defend’ the Constitution, the framers of the 14th Amendment never intended for it to apply to the president.”
Plenty of Similar Lawsuits
Trump is facing similar lawsuits across the country. The problem, according to legal experts, is that Section Three doesn’t specify how it should be enforced. Regardless, public opinion is clear – the majority of Americans do not want somebody who incited an insurrection making a bid for the White House.

News of Trump’s latest defense was shared across the internet and, as previously mentioned, most people laughed it off and said they don’t want him on the ballot. A few of his fans popped up from time to time to defend him and attack the Biden administration but, for the most part, people were against the former president.

Others actually said keeping Trump on the ballot could be better for America because he has virtually no chance of winning. These individuals often looked to DeSantis and pointed out that he’d be the likely replacement.

Another individual wrote: “Amazing! Well, there you go! It should be very easy to decide who to vote for in 2024. Trump is admitting right here, out loud, that he has no duty – even after his oath – to support the Constitution.”

People found the argument baffling. “Talk about trying to split hairs. Arguing that one word renders everything invalid when that word – ‘support’ – is a synonym for most of the oath. Good grief, I hope the judge sees straight through this rubbish and sends him packing,” another commenter said.

Another commenter wrote: “Are they really trying to use semantics to defend this traitor? Unbelievable! This guy is just one hoax after another! How can you defend the Constitution if you don’t support it? Don’t these lawyers have any common sense at all?”
