Initially making headlines in 2015, the conservative Christian clerk – who has been married four times -refused to provide marriage licenses to gay couples following the U.S. Supreme Court’s legalization of same-sex marriage. She defended her actions by asserting that she was acting “under God’s authority,” believing that marriage should remain a covenant between a man and a woman.

In response to her refusal, a Kentucky jury awarded David Ermold and David Moore – one of the offended couples – $50,000 each. Davis tried to protect herself by invoking “qualified immunity,” a legal clause that may safeguard government officials from personal liability in the case of violated rights.

As a result of this controversial decision, the jury decided to award not only one but both of the plaintiffs, David Ermold and David Moore, $50,000 per person. This hefty penalty totalling a staggering $100,000, was essentially a wake-up call for Davis, making her realize the gravity of her actions.

Judge David Bunning of the U.S. District Court in eastern Kentucky was responsible for the verdict. Not swayed by Davis’ plea of ‘qualified immunity’, he observed and emphasized that government officials cannot step over the line, thereby endangering personal rights, under the mere guise of executing their official duties. Davis, unfortunately, had made that very mistake. Judge Bunning ruled that Davis’ claim to religious freedom could not be used to violate the constitutional rights of others while carrying out her duties as an elected official.

Davis or an employee in her office repeatedly denied marriage licenses to at least two same-sex couples. The couples eventually received them from a deputy clerk when Davis was jailed for five days due to contempt of court, following this, her staff issued the licenses with Davis’ name removed. The incident led to the passing of a Kentucky law that removes county clerks’ names from state marriage licenses.

 

The Lawsuit and Its Consequences

Ermold and Moore, and another couple, James Yates and Will Smith, sued Davis for the “mental anguish, emotional distress, humiliation and reputation damages” they endured. Initially, Kentucky Gov. Matt Bevin (R) praised Davis as an inspiration, until he appealed to make Davis pay the legal fees after the court declared that the state government would cover them. This incident prompted a heated debate on the thin line between personal beliefs and professional responsibilities, opening up the floor for intense discussions and court battles.

Davis was represented by the anti-LGBTQ Liberty Counsel, a group designated as a hate group by the Southern Poverty Law Center, due to their staunch opposition to any expansion of LGBTQ+ civil rights. Despite their rigorous defense and appeals on her behalf, the tide of public sentiment and the law was not on their side, ultimately leading to the hefty fine Davis is now faced with.

Liberty Counsel Chair Mat Staver declared that the organization is planning to appeal the court’s decision and take the case to the U.S. Supreme Court. Back in 2015, the Liberty Counsel claimed that Davis had a meeting with Pope Francis to discuss religious freedom, an assertion that the Vatican quickly debunked. The Vatican clarified that the Pope was unaware of Davis’ identity when she was snuck into a private reception by an Archbishop, who was later replaced.
